Find the article by our collaborator Jocelyne Niyomukesha devoted to the protection of non-professional investors within the European Union and in Switzerland in the latest issue of the Revue de droit international et de droit agréé which has just been published by Larcier.
This contribution, through the analysis of several Swiss and European Union regulations affecting both the consumer and the non-professional investor, aims to provide clarification through an essentially comparative approach. The prohibition relating to unfair business practices towards consumers as well as the regime applicable to misleading advertising, the prohibition of unfair terms, the rules regarding credits, the PSD 2 directive as well as the rules of the MIFID II directive and the LSFin law will thus be examined. The problem is as follows: does the Swiss “private” investor enjoy the same level of protection as the non-professional European investor and how can these two systems be mutually inspired?
